By accessing this website or purchasing any EVELOP products, including the EVELOP CGM system, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with any part of these terms, you must not use our website or purchase our products.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Intended Use: The EVELOP CGM system is intended for continuous glucose monitoring in adults and children (as specified in product documentation). It is designed to assist in diabetes management but is not a substitute for professional medical advice, diagnosis, or treatment.

Not a Replacement for Medical Care: Always consult with a qualified healthcare provider before making any medical decisions based on CGM readings. Do not use CGM data alone to make treatment decisions without consulting your doctor.

Accuracy Limitations: While our CGM system provides accurate readings (±15% MARD), sensor readings may vary from blood glucose meter readings. Factors such as sensor placement, body chemistry, and environmental conditions can affect accuracy.

Emergency Situations: If you experience symptoms of severe hypoglycemia or hyperglycemia, seek immediate medical attention. Do not rely solely on CGM alerts in emergency situations.

User Responsibility: You are responsible for reading and following all product instructions, warnings, and safety information provided in the user manual and product packaging.

Pricing: All prices are listed in the currency displayed on the product page and are subject to change without notice. We reserve the right to correct pricing errors.

Payment: We accept major credit cards, PayPal, Apple Pay, and Google Pay. Payment is processed securely through our payment partners. By providing payment information, you represent that you are authorized to use the payment method.

Order Confirmation: After placing an order, you will receive an email confirmation. This does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason.

30-Day Money-Back Guarantee: If you are not satisfied with your purchase, you may return unopened, unused products within 30 days of delivery for a full refund. Opened or used products cannot be returned due to health and safety regulations.

Return Process: To initiate a return, contact our support team at support@evelop.com with your order number. You are responsible for return shipping costs unless the product is defective or we made an error.

Refund Timeline: Refunds will be processed within 7-10 business days after we receive and inspect the returned product. Refunds will be issued to the original payment method.

Subscribe & Save Program: When you choose the Subscribe & Save option, you agree to receive automatic shipments of CGM sensors every 15 days at a 10% discount from the regular price.

Automatic Billing: Your payment method will be automatically charged every 15 days before each shipment is dispatched. You will receive an email notification 3 days before each billing date.

Subscription Management: You can manage your subscription (skip shipments, change frequency, update payment method) by logging into your account or contacting support@evelop.com.

Cancellation: You may cancel your subscription at any time with no penalty or cancellation fee. Cancellations must be made at least 2 days before your next billing date to avoid being charged for the next shipment.

Price Changes: We reserve the right to change subscription pricing with 30 days' advance notice via email. You may cancel your subscription before the price change takes effect.

Subscription Pausing: You may pause your subscription for up to 90 days. Contact support to arrange a pause.

Shipping Times: Estimated delivery times are provided on the product page and vary by destination. These are estimates only and not guaranteed delivery dates.

Shipping Delays: We are not responsible for delays caused by customs clearance, public holidays, natural disasters, or carrier issues beyond our control.

International Orders: International customers are responsible for any customs duties, taxes, or import fees imposed by their country. These charges are not included in our pricing.

Lost or Damaged Shipments: If your order is lost or arrives damaged, contact us within 7 days of the expected delivery date. We will work with the carrier to resolve the issue or send a replacement.

To the maximum extent permitted by law, EVELOP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising from:

• Your use or inability to use our products or services
• Any inaccuracy or error in CGM readings
• Unauthorized access to your personal data
• Any medical decisions made based on CGM data
• Product defects or malfunctions

Maximum Liability: Our total liability to you for any claims arising from your use of our products or services shall not exceed the amount you paid for the product in question.

Warranty Disclaimer: Products are provided "as is" without warranties of any kind, express or implied, except as required by law. We do not warrant that our products will be error-free or uninterrupted.

You agree to indemnify, defend, and hold harmless EVELOP, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of our products, violation of these Terms, or infringement of any third-party rights.

Governing Law: These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

Dispute Resolution: Any disputes arising from these Terms or your use of our products shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.

Class Action Waiver: You agree to resolve disputes on an individual basis only and waive any right to participate in class action lawsuits or class-wide arbitration.

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
